driving a vehicle while texting aka "distracted driving" is extremely dangerous and offensive. Studies indicate the reckless behavior is just as or more dangerous as driving under the influence of alcohol. Thus, and in the same manner previous administrations encouraged States to enact .08 B.A.C. laws, the availability of federal highway funds shall be dependent upon States enacting legislation to criminalize distracted driving. Similar to DUI and/or "reckless driving" or merely driving without a valid driver's license, distracted driving that does not cause great bodily injury should be a misdemeanor punishable with jail time. Legislation can and likely should include an option for first offenders to have the charge reduced to an infraction punishable by a fine only, the current sentence.
