Declare Boston Bombing terrorist Dzhokhar Tsarnaev an enemy combatant

On April 15th, 2013, two individuals engaged in open hostilities against the government and people of the United States by planting improvised explosive devices during the course of the Boston Marathon. One has since died, the other, Dzhokhar Tsnaraev, remains in custody. Additionally, these terrorists murdered an MIT police officer and expressed intent to use weapons of mass destruction in other locations in the U.S. Given the preponderance of the evidence pointing to their guilt including a hospital confession, I petition the Obama administration to declare Dzhokhar Tsnaraev an enemy combatant, suspending the constitutional protections he enjoys as an American citizen. This individual should be given no preference, legal, moral or otherwise over the lives of his victims.
