We recognize that a decision to remove all criminal penalties for the cultivation, possession, or use of marijuana may lie with the Congress. However, the Attorney General retains prosecutorial discretion as to how to enforce federal laws. Federal laws are becoming increasingly in conflict with State laws with regard to marijuana. More and more States are choosing to legalize and regulate marijuana for medical and recreational use.
Accordingly, we request that the President of the United States direct the Attorney General to decline the prosecution of federal laws regulating the cultivation, distribution, possession and use of marijuana where such activities are conducted in conformance with State laws.
