The Digital Millennium Copyright Act was originally drafted in 1998, two years before the "Digital Millennium" began. At the time, we were still using dial-up Internet connections to get online. YouTube, Netflix, Hulu, and even iTunes were still many years away. I commend Congress for trying to be proactive, but in the case of the DMCA, it just didn't work. The law was written in such a one-sided manner that there were very few protections for consumers and smaller media producers, if any, and it gave too much power to major industry interest groups, like the Motion Picture Association of America and the Recording Industry Association of America. The DMCA also encouraged the use of invasive techniques to try and combat piracy, which only hurt legitimate customers.
