The swap of prisoners for Sgt. Bowe Bergdahl was illegal, as Congress was not informed at least 30 days before the movement of the prisoners from Guantanamo Bay. The move constitutes an outright rejection of federal law by the President and his staff, and must face punishment to prevent future ignorance of the law by the executive branch. Moreover, the action sets a dangerous precedent of negotiating with terrorists, potentially encouraging the taking of more U.S. troops hostage. Furthermore, members of the armed forces who knew Sgt. Bergdahl believe him to be a deserter, and there is suspicion that he aided the enemy during his time as a hostage.
