Deny military spouses retired pay in divorce.

Created by G.C. on January 18, 2013

The majority of military members do not make much in retirement pay after taxes and it is an atrocity to grant spouses to divorce any of it under certain circumstances. It takes 20 years for a service member to get entitled to retired pay, but it only takes 1 day of marriage for a spouse to be entitled to a portion of it. It is wrong. The spouse should also be required to be married for 20 years, with 20 years of overlapping military service to be qualified for any retired pay. In certain cases, even if the 20/20 rule is met, a non-military spouse "at fault" in a divorce should not be granted any retired pay.
