Second, despite the Obama administration stating that foreign nationals here on a visa are protected under the first amendment, it was decided by the Supreme Court during the Bluman v. FEC case in January 2012 that the first amendment does not apply to non-citizens. Lastly, foreign nationals can be deported for the subversion of the constitution, as decided by the Harisiades v. Shaughnessy (1952) case.
