Discrimination law has not yet reached up to our 21st century society. Under federal law and to a great extent, under state law as well independent contractors still receive little protection against discrimination. For ex; the main federal antidiscrimination statute, Title VII, expressly excludes independent contractors from its protections.
In contrast, even potential employees are protected by Title VII and other laws; they can bring hiring discrimination claims. Seeking job opportunities as an employee provides more rights that an independent contractor cannot provide.
There are a number of clear reasons why independent contractors should benefit from the protection of discrimination law. and the U.S. Constitution should uphold our rights to life, liberty and pursuit of happiness.
