Currently, corporations and their executives avoid prosecution for crimes through "deferred prosecution" wherein they are allowed to conduct self-serving investigations into wrongdoing. The DOJ negotiates away the culpability of the perpetrators and lets corporations adjust their modus operandi without any real penalty for those responsible. The latest example of this absurd situation is the on-going cover-up of culpability in the mortgage disaster that has brought our economic system to the brink of collapse, yet leaves the executives responsible free of any threat of prosecution.
