Currently a driver age 21 & above can legally drive with some alcohol in their blood while their counterpart drivers age 16-21 are allowed zero alchohol in their blood . This is discrimination. The young people who are charged with a DUI only because of their age are discriminated against several ways. First, they are held to a higher standard than someone only months or a few years older than them. Second, they do not qualify for a public attorney and are denied legal help since they are not facing jail time. They are abused by the system since they are young and many unable to afford legal help. Further if you are not driving and you drank at home in a legal fashion you can be charged with a MIP without any hard evidence other than the officers observation.
