Congress has arguably been more inefficient in the past decade than in any previous period in history, often because of the use of the procedural filibuster. The use of the filibuster was uncommon until the Senate created the procedural filibuster. The procedural filibuster basically allows a Senator to filibuster without talking. Since 60 votes are required to override a filibuster, the minority party, whether Republican or Democrat, has filibustered almost every major piece of legislation in the Senate. The Constitution says that 51 votes are needed to pass a bill, but the procedural filibuster has turned that number into 60 votes. One party rarely has a 60 vote majority.
