eliminate second and third position liens on homes when debts secured by the liens are discharged during bankruptcy

Created by S.M. on November 13, 2012

When a homeowner files and receives a discharge of debts during bankruptcy, liens in second and third positions that are secured by the debts discharged should be automatically eliminated. This would allow a homeowner to refinance a first mortgage if he/she choses, but would truly give the homeowner a fresh start because liens in second and third position are eliminated. Otherwise, the only option to ever become a true homeowner is to relinquish the home and start over elsewhere. If debts are discharged during the bankruptcy process, the second and third positions liens also should be discharged by law and part of the bankruptcy process.
