Individuals who are permanently disabled can presently have student loan debt discharged by the Dept. of Education. But any such loan discharge is considered “cancellation of debt” income by the IRS and thereby forces the disabled to pay taxes on money they never received. This is unduly burdensome to low-income disabled individuals and their families. It also severely limits or eliminates financial aid awards for children of the disabled in need of funds to attend college in the year after the discharge was granted.
