An employer can ask for employees to volunteer to work overtime at any time prior to the start of hours asked to work. Employers shall be required by law to pay employees volunteering for overtime one and a half times the employee’s normal rate of pay. Example: Normal rate of pay $10.00 per hour. Voluntary overtime rate of pay $15.00 per hour. If no employee volunteers to work overtime and the employer then is forced to mandate the overtime, the rate of pay shall fall to the voluntary one and a half times the normal rate of pay. If some employees volunteer, but other employees are mandated to work overtime, the mandated employees shall be paid two times their normal rate of pay.
Overtime for Sundays and holidays shall be at two times the normal rate of pay.
