Reselling entertainment tickets for a highly inflated value, Scalping, near a venue is illegal. It should be the same for ticket resale web-sites (Stubhub!). If selling over-priced tickets near a venue is illegal, it should be the same if the internet is used as a medium to sell these over-priced tickets. The purpose of these websites are to scalp people and make profit from it. It simply is not ticket-reselling.
It makes no sense to have these laws, when the internet is a safe-haven for scalpers.
If I bought a few $15 dollar tickets, and sold them for $150 dollars at a venue it's illegal. However, If I sold these tickets for $150 on ticket resale sites, it is perfectly legal. It makes no sense.
Second hand resales should be illegal because in the end, it's still considered scalping.
