North Dakota is the only state in the country which requires by state statute that a pharmacy be majority-owned (at least 51 percent or more) by a licensed pharmacist in good standing.
This effectively stifles competition in the state. For example, the much-advertised generic prescription offers are not available in North Dakota because none of the big box stores are allowed to operate their own pharmacies in North Dakota. Not even Walgreens. A drug store company for gosh sakes can't own a pharmacy in North Dakota!
This is a ridiculous law which has been in place since 1963. Numerous attempts to repeal it have all failed.
I believe this law is an unconstitutional restraint of free interstate trade.
