To reduce the irreparable harms caused by the adjudications delays of veterans' disability claims; The Secretary, Department of Veteran's Affairs shall grant an Interim disability rating of 50% to each claimant where a determination of ineligibility supported by clear and convincing proof cannot be immediately established. Such Interim ratings will be granted within 30 days of the initial receipt of any written claim by a veteran or his or her representative, for any service connected disease or injury and shall remain in effect until a Final Adjudication of the claim is accomplished. Upon a formal decision the Interim claim will be reconciled to reflect the findings reflected in the final decision. The Secretary may reasonably recoup a overpayment for a total of six months of payments.
