An inmates civil rights are restricted, but human rights should never be taken away.

In 2003, the Prison Rape Elimination Act (PREA) was the first law against prison rape. The law mandated the National Prison Rape Elimination Commission (NPREC) to be created. In 2008, the NPREC was even extended. Yet, the NPREC was for collecting prison rape occurrences; making the data available. Thus, creating a zero-tolerance policy about getting data on prison rape, but not stopping/deterring it.

Officials are aware of the 3,220 assaulted juveniles in 2009, 90,000 female rapes and 140,000 male rapes in 2006. Now in 2013, further action is needed.

-Separation of sexual offenders from nonsexual offenders
-Female guards to female prisoners
-Male guards to male prisoners
