By codifying North Carolina Legislation HB2 into law which bans Transgendered citizens from using the restroom that they deem most appropriate, the State of North Carolina also violated Title IX, a portion of the U.S. Education Amendments of 1972, Public Law No. 92‑318, 86 Stat. 235 (June 23, 1972), codified at 20 U.S.C. §§ 1681–1688.
It states: "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance."
On April 19, 2016 the Fourth Circuit Court of Appeals upheld the Department of Education’s interpretation of existing federal civil rights laws to protect transgender people against discrimination in education.
