Ensure that Consumers and Not State Legislators Decide Whether a Company can Sell its Products Directly to Consumers.

Please ensure that the Justice Department and FTC enforce the Constitution’s interstate commerce clause in cases in which a state legislates that a manufacturer must not sell or service its products directly to consumers. Requiring a manufacturer to sell its products only to franchised dealerships is contrary to the commerce clause, unless a contract exists.

No law forced Henry Ford to sell his cars only to franchisees. In his era it made sense. Contracts were sufficient. Now products can be custom built through internet orders. There is no benefit in selling to middlemen. If consumers believe otherwise, then the market will either put a manufacturer out of business or force it to franchise dealerships. But that should be a choice left up to American consumers, not state legislators.
