Trustees and conservators are frequently granted absolute authority over persons with memory disorders and other disabilities by local or state laws, which vary wildly from place to place. Under the protection of those laws, trustees can act with virtual impunity; it is often virtually impossible for family members to intercede or seek recourse in situations in which the trustor (person under control of trustee) or the trustor's assets are being mismanaged by improperly performing trustees. Great damage can be done to the trustor and the family by rogue trustees, of which there appear to be many. State agencies for the management of trustee licenses are underfunded and do not serve properly. Federal standards for the performance of trustees is imperative as are standards for recourse.
