The Final Ruling released on 5 May 2016 by the FDA called for the imposition of Option 1, imposing restrictions on the manufacture and sale of premium cigars. These restrictions are not backed by any evidence that such restrictions are needed.
I. Minimum age to purchase. . Because of current state limits, FDA actions to impose a federal limit are unneeded and heavy handed.
II. Released medical evidence by the FDA. The medical evidence used by the FDA does not support a health risk need for federal regulation of premium cigars.
The FDA’s Final Ruling, issued 5 May 2016, imposing Option 1 on premium cigars is unwarranted and unnecessary regulation. We request that an Executive Order be issued exempting premium cigars from FDA regulation.
