Federalize the National Guard if necessary to ensure states enforce the Supreme Court's decision in Obergefell v. Hodges

Created by J.B. on June 29, 2015

This is a position to urge the President to uphold his obligations to "take Care that the Laws be faithfully executed" by ensuring that each state immediately complies with the Supreme Court's ruling in Obergefell v. Hodges, which constitutionally compels states to perform same-sex civil marriages.

In response to the ruling, several states have expressed their intentions to stall or halt implementing the Court's ruling, which is the Law of the Land. The Alabama Supreme Court, in defiance of both the U.S. Supreme Court and a federal court order, issued its own order allowing judges to refuse to issue same-sex couples marriage licenses.

To ensure our nation's laws are upheld, the President should use every power of his office, including his power to federalize the National Guard if needed
