The US Constitution says that the US President, duly elected in 2012, shall appoint a candidate to fill the recent vacancy on the US Supreme Court, subject to the advice and consent of the US Senate. Once the President has nominated a qualified candidate, if the US Senate refuses to hold hearings and vote on that candidate, they are failing to uphold their Constitutional duty. In that case, the President should file suit in federal court to force the US Senate to do its job to offer its advice and consent regarding that nominee.
