We ask the President to enforce the Constitution by doing whatever is necessary to fill the empty Supreme Court seat before the presidential election in November, such as referring this issue to the Court itself. Obama has fulfilled his duty in this matter by nominating a respected judge, in a timely manner as required.
However, senate majority leader, McConnell, has publicly stated he will not even allow a senate hearing for any judge that Obama nominates until McConnell can determine who will likely be the next president.
The Constitution demands that the Court always be ready to resolve crises such as election 2000 when environmental presidential candidate Al Gore was denied a recount vote in Florida, thus losing the presidency to George Bush by just 537 Florida votes.
