Anton Scalia's death opens up a seat on the Supreme Court. The Constitution grants the President the right to appoint his replacement, WITH the Senate's advice and consent.
Republican leaders in the Senate have already announced they WOULD NOT entertain an appointment from President Obama, suggesting that it should be the decision of the next President (and assuming the next President will be a Republican.)
Interestingly, the President is also granted the right to make a "recess appointment" WITHOUT the Senate's advice and consent.
The Senate is currently in recess until February 22.
I'm respectfully petitioning the President to make the appointment prior to the Senate's return from their recess on February 22, 2016.
