James Clapper lied to congress when he was asked, under oath, by Senator Ron Wyden, whether the NSA was collecting data on American citizens that are not suspected of any crime.

He answered no, twice. Which we now know is a lie. So he committed perjury by lying to congress.

Mr.Clapper is still in the Obama administration even though he perjured himself, but Edward Snowden was charged with 3 felonies by the Obama administration 24 hours after he identified himself as the one who leaked the NSA documents to the press. He did this out of conscience, not greed or harm to his country.
