FLAG DESECRATION RESTRICTIONS

Created by M.H. on May 01, 2015

Currently, the desecration of our National Colors is allowed because of the following: "The U.S. Supreme Court has ruled that due to the First Amendment to the United States Constitution, it is unconstitutional for a government (whether federal, state, or municipality) to prohibit the desecration of a flag, due to its status as "symbolic speech." However, content-neutral restrictions may still be imposed to regulate the time, place, and manner of such expression."

Currently many people want to burn the flag to insult Veterans and their supporters. In many OIF/OEF PTSD Veterans meetings chief complaint about current events is that they see the blatant disrespect of the flag as a personal insult. It is petitioned that restrictions be implemented if desecration of the flag is permitted.
