Arne Duncan has violated the rights of students with disabilities. His high stakes testing and the unattainable expectations for students with disabilities is a direct violation of the Individuals with Disabilities Education Act which states that we must provide services based on the student's needs. In implementing Common Core, he is devaluing the nature of the law but asking educators to focus on tests and scores without realizing that our duty is to the child and to his/her specialized needs. These students require more time to learn; therefore, to have them take tests at grade level is not only ridiculous, it is bad practice and a violation of their IEP! Intellectually disabled students should not be asked to take grade level tests!
