It was the original intent of LEOSA 2010 to grant firearm concealed carry privilege to all law enforcement officers (LEO) within the Executive Branch. This benefit was additionally afforded to the Amtrak Police and the Federal Reserve Police, both non-government entities. The Department of Defense (DOD) has taken the position that since the wording of LEOSA requires that those covered have statutory powers of arrest, DOD LEOs do not qualify since they have apprehension authority (a term that anywhere else is interchangeable with "arrest"). We believe that LEOSA did not intend to overlook DOD LEOs, and that this was an oversight. It is therefore requested that statutory powers of arrest be granted to DOD LEOs as a strong and appropriate remedy.
