If the rule of law applies, regardless of affiliation, (as claimed by the White House Chief of Staff), then AG Lynch, needs to recuse herself, since she met with President Clinton, and appoint a special prosecute, to indict Hillary Clinton for the mishandling of secret and top secret emails; transferring of them from the secure military system to her PRIVATE server, which we know was hacked by at least one individual, possibly more. To not charge her, is to demonstrate to the American people that Hillary Clinton is above the law. When it comes to classified documents, intentions to not matter, what does is what actually happens with them. In this case, she (and/or her staff) clearly broke the law.
