Have the IRS Quickly Issue Post-DOMA Guidance for Married Same-Sex Couples and Their Employers.

It has been some time since the Supreme Court has declared the Defense of Marriage Act unconstitutional, but same-sex couples around the country and their employers are still waiting for action from the IRS.

We ask that President Obama instruct the IRS to quickly issue guidance for same-sex couples that states that any couple whose marriage was lawful in the jurisdiction entered can file as married for federal tax purposes, and that describes the rights/procedures for already married same-sex couples who wish to refile previous years' tax returns.

We also ask that President Obama instruct the IRS to issue guidance for employers asking them to provide married same-sex employees with updated W2 forms, and outlining the process to refund overpayments in FICA/Medicare taxes.
