We ask the Justice Department to bring a suit against the Ferguson Police Department. Federal civil rights law prohibits law enforcement from engaging “in a pattern or practice of conduct . . . that deprives persons of rights, privileges, or immunities secured or protected by the Constitution or laws of the United States.” We believe that in the shooting death of Michael Brown, Officer Darren Wilson’s actions — and the subsequent and continual actions of police armed with riot gear, tear gas and “non-lethal” ammunition — constitute such a “pattern or practice,” police in Ferguson that violates federal law. In addition, the actions of Prosecutor McCulloch may constitute misconduct and grand jury tampering by allowing Darren Wilson to testify and by providing exculpatory evidence.
