Under the Fresh Start Act H.R. 4410 qualifying ex-offenders would be eligible to apply to a federal court to have their convictions expunged from their records if they have not committed any other state or federal offense and have meet all the terms of their sentence and are now law abiding productive members of society. The US attorney for that district would be allowed to submit recommendations to the court. Applicants who are denied can reapplied once every 2 years. After 7 years expungement will be automatically granted. Also encourage states to pass their own expungements laws for ex state offenses. State that pass a substantially similar law would receive a 5% increase in federal funding for local law enforcement the Byrne/JAG program while those do not would lose those funds.
