The Take Care Clause requires the President "take care that the Laws be faithfully executed." The federal Controlled Substance Act classified marijuana as a Schedule One substance. The laws of the federal government apply in all states under the Supremacy Clause of the Constitution. By not enforcing the laws, the President is not performing his constitutional duties and is allowing federal laws to be broken with no justice or repercussions.
