The NSA is breaking the 4th Amendment by implementing the program PRISM. Last March, the Director of National Intelligence James Clapper was asked, "Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?" He responded that they do not do so "wittingly," even though they have the means and capability to do so under secrecy.
