Almost immediately after Justice Antonin Scalia passed away, Senator Mitch McConnell publicly announced that they will not consider any nominee the President presents to replace him. Senator McConnell has publicly maintained the position that a sitting President, despite the Constitution, should not be allowed to fulfill his Constitutional duty because he is in the last year of his term. Senator McConnell and the members of the Judiciary Committee who ignore the nomination of Judge Merrick Garland are in direct violation of the Constitution. We, the undersigned hereby request the Department Of Justice open a case charging Senator McConnell and the other Republican members of the Judiciary Committee with violations of the Mandamus Act and ordering them to have proper meetings and votes.
