Invalidate All State Laws Requiring a License to Exercise a Fundamental Right Under the Second Amendment.

Congress should enact legislation that would invalidate any and all state laws requiring a person to first obtain a license or permit before he or she can exercise a fundamental right under the Second Amendment. Such a bill would prohibit states from enforcing any law that prevents a person from owning and possessing usable and loaded firearms, including handguns, carrying them within the home and using them for traditionally lawful purposes, such as self defense, without first obtaining a license or permit. In essence, all states that currently treat ownership and possession of long arms differently from handguns, requiring a person to obtain a license or permit to own a handgun but not a long arm, would have to end this unconstitutional and immoral practice.
