McKay's arrest and conviction rested almost entirely on the victim's ID of him in police lineups. Physical evidence during McKay's trial linked another man, Keith Esters, to the crime. McKay's attorneys were denied requests to bring that evidence before the jury. Both the state appeals court and the Missouri Supreme Court denied requests for the trial to be reviewed for improprieties. McKay's trial should be reviewed by the Department of Justice Civil Rights Division and McKay should be allowed a retrial allowing all evidence to be presented.
