Mark E. Kelly, attempted to purchase an AR-15 on March 5, 2013 at Diamondback Police Supply, 170 S Kolb St, Tucson, AZ.

He reportedly answered "yes" to question 11a on the ATF form 4473, which reads: Are you the actual buyer of the firearm(s) listed on this form? Warning: You are not the actual buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual buyer, the dealer cannot transfer the firearm(s) to you."

Additionally, 4473 reads:"I certify that the above answers are true and correct. I understand that answering “yes” to question 11a when I am not the actual buyer of the firearm is a crime punishable as a felony."

March 8, he posted:"I don't have possession yet but I'll be turning it over to the Tucson PD."

This was an attempted straw purchase.
