Federal regulation of beachfront lighting is needed so that measures to protect nesting sea turtles (and the resulting hatchlings) can be understood, implemented and enforced with consistency.

Current regulation of beachfront lighting consists of a non-uniform, confusing mixture of local ordinances. Many simply “encourage” lights to be out from March 1 to October 31 (turtle nesting season). However, these local laws can be ineffective because of (i) the lack of meaningful penalties and (ii) the unwillingness of beach towns to enforce lighting regulations against its own citizens. Also, tourists who visit beaches may not be aware of artificial light regulations.
