Since 1938 and the FFDCA the U.S. has had a ban on candy with toys inside of them for the "safety of the children". The most well-known candy to be affected by this ban has been the Kinder Chocolate Surprise Eggs made by Ferrero in Italy. These delicious treats are not only completely safe for children above the age of three (which is Ferrero's target audience), but they are considered to be one of the best treats for Easter around the world. These delicious eggs are harmless to kids because the toy inside could barely fit down most adult's throats let alone adolescents.The choking hazard that has most people falsely worried isn't even a problem. So there should be no reason American consumers cannot buy this product if they choose.
