Presently end user license agreements (EULA) and Terms of Service (ToS) are able to override or trump many laws. Any new law that is passed which is in favor of the consumers which the software publishers do not like, all they have to do is modify the EULA to nullify the effects of that new law.
I propose that no EULA or ToS shall override or trump civil rights, copyright laws or consumer protection laws.
All EULAs and ToS must be straightforward, upfront and specific as to ALL software that being installed.
The consumer has the right to return any software for a full refund if they do not agree with the EULA.
