Any crime in which a firearm is used is automatically a Federal Crime, punishable by a Federal Prison term, with a minimum sentence of 10 years in Federal custody. The threat of a firearm, in which the criminal even pretends to have a gun, such as a note to a bank teller or store clerk claiming to have a gun or using a finger in a jacket pocket against a person on the street, is a minimum 7 year Federal Prison term.
