A DDoS attack or Distributed Denial of Service attack is a legitimate way of protesting on the internet. Groups such as Anonymous and LulzSec use this method to protest certain websites and companies. It is the equivalent to hitting the refresh button a couple hundred to a couple thousand times. The government has made DDoSing illegal in the U.S.because they believe it is a type of cyber terrorism, it is not. It's the online version of chaining yourself to a door of a building or protesting and blocking the entrance to a business. It's like an online peaceful protest that's why I believe DDoS attacks should be legal.
