The Fourth Amendment to the Constitution restricts the government from illegal search of private property.
By making Email accounts, Cell Phone accounts, social networking accounts and other communication accounts and their contents the private property of the user, the government, business and third parties must gain explicit permission of the court or the user before accessing these accounts and their contents. This includes all data from these accounts including location, usage, emails, texts, images, etc.
By making these private property a long series of criminal and civil legal questions will be resolved by the constitution, and providers, users and the government will have a clearer understanding of electronic privacy and how to respect it.
