In this economy, giving someone a felony for being unemployed should be illegal. If you are the noncustodial parent and are ordered to pay child support but cannot find a job, getting a felony will greatly decrease your chances of finding one as so many employers now conduct background checks. Also, if you end up in jail for an extended period of time, your child is missing not only your financial support but your emotional support as well. Unemployed noncustodial parents should be required to document their job search in order to stay out of jail. Also, the noncustodial parent could be used as a resource for their child by spending more time with that child until they are gainfully employed. If the custodial parent is unemployed, they don't face a felony. Why should the noncustodial one?
