Justice Thomas's wife earned nearly $700,000 over 5 years lobbying for the health care industry and against health care reform. Justice Thomas reported that his wife did not receive income from the group she represented. According to US Code Title 28 Part 1 Chapter 21, a Justice should recluse themselves if ... "he ...or ...his spouse has a financial interest in the subject matter in controversy or in a party to the proceeding, or any other interest that could be substantially affected by the outcome of the proceeding." Clearly, an addition of $700,000 in household income from the Heritage Foundation represents a substantial 'interest' for Justice Thomas against health care reform.
