Make key elements of Abood part of the Fair Labor Standards Act or other federal level legislation

The Fair Labor Standards Act extends protections to Home Care Workers and Personal Support Workers in Oregon effective January 1, 2015. Home Care Workers and Personal Support Workers as "full-fledged" public employees of the State of Oregon are in a position to advocate embedding of key elements of Abood v. Detroit Board of Education in 1977 in federal level worker protection legislation. Key elements of Abood focus on a union's collective bargaining and contract-administration activities incurring costs to negotiate with a state the terms of compensation, benefits, and other terms of employment. The point of Abood is the costs of collective bargaining unit are a shared responsibility for all individuals in it making an "agency fee" a reasonable reimbursement to a union's efforts.
