Kinder Surprise Eggs are banned in the US for 2 reasons that no other country seems to be very concerned with.

Firstly, they contain small parts that present a choking hazard to young children. Well, a LOT of things out there present a choking hazard to young children, in all those other cases the warning label seems sufficient.

The second reason is that a section of the Federal Food, Drug, and Cosmetic Act of 1938 (75 years ago, mind you) says that "a confectionery product with a non-nutritive object, partially or totally embedded within it, cannot be sold within the United States." This has not stopped an imitator from basically coating a plastic egg in chocolate (I would call that partially embedded) and some how that is legal and Kinder eggs are not.

Let's make the real deal legal!
